Jennings told Fox News 5 in
DC that she took the flu shot to receive "points" on her employer-sponsored
healthcare plan that provides "perks" for each level of wellness
that is attained by the covered employee. Jennings told the TV reporters
who interviewed her that prior to taking the flu shot, she was healthy
and active. Thus, she was not in any high-risk group for
any side effects.
In the top video, the announcer from Channel 16 says what happened to Desiree should discourage people from getting flu shots. Comments attached to the video noted that since the FluVac "...was approved by the World Health Organization" that should somehow make it safe for everyone. No vaccine in the world is "safe for everyone." Someone using the screen name BrickCityKingz decided Jennings was faking, concluding that "...the whole thing was a hoax. The story," this intellect decided, "was a hoax. This story was fabricated in order to support the campaign against the swine flu vaccine. If anyone fell for this sh*t they're an ignoramus." The individual who posted the original information on the top video, 91177info, went back and dug up corresponding information that supported his or her initial YouTube posting that, Desiree Jennings [a] is not faking her neurological condition, and [b] she somehow managed to contract a one-in-a-million neurological condition known as Dystonia from a vaccine "batch" which the CDC checked and found to be free of contaminants. Sadly, the likelihood of Jennings and her husband prevailing in a Vaccine Court are just about nil since to win a settlement in the special courts designed to control lawsuits with regulated settlements against vaccine manufacturers the plaintiff has to prove that pharmaceutical company that manufactured the vaccine which caused injury or death had to know, or at least suspect, the vaccine was not safe. In 1988 Congress enacted the National Childhood Vaccine Injury Act (42 USC §§ 300aa-1 to 300aa-34) to reduce the potential liability of vaccine makers due to vaccine injury claims. Under the law, the National Vaccine Injury Compensation Program (which makes the taxpayers and not the pharmaceutical companies liable for damages) created a "no-fault" system through the US Court of Federal Claims.
